Terms of Service

1. Acceptance of Terms

By accessing or using CarveNext ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and CarveNext.

2. Description of Service

CarveNext is an AI-powered career intelligence platform that provides resume management, job match analysis, interview preparation, competitiveness insights, and application tracking tools. The Service uses artificial intelligence to analyze your career data and provide personalized recommendations.

3. Account Registration

  • You must be at least 16 years old to create an account.
  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • One person may only maintain one account. Creating multiple accounts is prohibited.

4. Subscription Plans & Payments

4.1 Free Plan

The Free plan provides limited access to CarveNext features with monthly usage caps. Free plan features may be modified at any time.

4.2 Paid Plans (Pro, Pro+)

  • Paid subscriptions are billed monthly through Stripe.
  • Your subscription will automatically renew unless cancelled before the renewal date.
  • You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
  • No refunds are provided for partial billing periods.
  • We reserve the right to modify pricing with 30 days' notice to existing subscribers.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Upload false, misleading, or fraudulent resume or career information.
  • Attempt to access other users' accounts or data.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated systems (bots, scrapers) to access the Service without our written permission.
  • Circumvent usage limits or abuse free tier allocations.
  • Upload malicious content, viruses, or harmful code.
  • Use the Service to generate content that is defamatory, harassing, or violates others' rights.
  • Resell, redistribute, or commercially exploit any part of the Service without authorization.

6. Your Content

6.1 Ownership

You retain ownership of all content you upload to CarveNext, including your resume data, job descriptions, notes, and other materials ("Your Content"). We do not claim ownership of Your Content.

6.2 License Grant

By using the Service, you grant CarveNext a limited, non-exclusive, non-transferable license to process Your Content solely for the purpose of providing the Service to you. This includes processing through AI models for analysis and recommendations. This license terminates when you delete your account.

6.3 Responsibility

You are solely responsible for the accuracy of Your Content. CarveNext is not liable for any consequences arising from inaccurate, false, or misleading information you provide.

7. AI-Generated Content

  • AI-generated analyses, recommendations, resume enhancements, and interview preparation materials are provided as suggestions only and should not be relied upon as professional career advice.
  • AI outputs may contain errors, inaccuracies, or biases. You are responsible for reviewing and verifying all AI-generated content before use.
  • Match scores, competitiveness assessments, and skill gap analyses are estimates based on AI interpretation and may not reflect actual hiring decisions.
  • CarveNext does not guarantee any specific career outcomes, job placements, or interview results from using the Service.

8. Intellectual Property

The Service, including its design, features, code, AI models, and branding, is the intellectual property of CarveNext. You may not copy, modify, distribute, or create derivative works based on the Service without our written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARVENEXT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless CarveNext, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

  • You may terminate your account at any time by deleting it through your account settings.
  • We may suspend or terminate your account if you violate these Terms or engage in prohibited conduct.
  • Upon termination, your right to use the Service ceases immediately. Your data will be deleted in accordance with our Privacy Policy.
  • Sections 6.3, 10, 11, and 12 survive termination of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Texas.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
